"Happy Birthday, Constitutional Breach!"

gbs and ifw publish "constitutional breach ticker" to commemorate the 99th anniversary of the Weimar Constitution

99 years ago today, on 14 August 1919, the Weimar Constitution came into force. On the 99th birthday of the democratic constitutional state also begins the "100th year of the constitutional breach", because to this day the demands of the Weimar Constitution, i.e. equal treatment of all religions and worldviews as well as the redemption of state payments to the churches, have not been implemented.

The decisive provisions of the Weimar Constitution on the separation of state and church (Art. 136, 137 and 138 WRV) were incorporated into the German Basic Law in 1949 (Art. 140 GG) - which, however, remained largely without consequence in politics and jurisprudence. For this reason, the Giordano Bruno Stiftung (gbs) and the Institut für Weltanschauungsrecht (ifw - Institute for Secular Law) published a "Verfassungsbruch-Ticker" ("constitutional breach ticker") to commemorate today's "99th anniversary of the democratic constitutional state", which shows how long Germany's leading politicians have been disregarding the principle of worldview neutrality of the state.

In the "100th year of the constitutional breach", gbs and ifw will launch various activities to create greater social awareness for this legal scandal, which is discussed far too rarely. As a prelude, Michael Schmidt-Salomon published a philosophical article on legal principle online, which analyzes the "blind spot of the German legal system" and demonstrates its profound practical consequences. The disregard of the state's ideological neutrality entails that the citizens' liberty rights are still being restricted by "irrational, empirically unfounded and ideologically biased legal norms" - from the "cradle to the grave, even beyond, i.e. from embryo protection to the requirement to bury the dead in a cemetery".

The articles 136-138 WRV still determine the constitutional relationship between state and church, which is, however, culpably ignored politically (source of scanned documents: Wikisource).
